A CUMBRIA police sergeant is facing the sack after he allegedly suggested a bail condition of ‘not to breathe’ to youth suspects.

PS Graham Boyd will face a misconduct hearing after allegations that he breached standards of professional behaviour in an assault investigation.

Allegations include sharing data relating to a live operational policing matter about an investigation to the mother, named Ms A, of the complainant as well as discussing evidence with her and prompting the provision of further information from her child to bolster the prosecution case.

He is also accused of making ‘highly inappropriate’ comments about youth suspects.

PS Boyd allegedly told Ms A ‘these scruffy little f**** can sit in the cell a bit’ as well as reportedly suggesting a proposal of a pre-charge bail condition of ‘not to breath’ and ‘you are prohibited from being alive’.

Referring to the proposed arrest of youth suspects he allegedly said 'will send two of mine to lock the lass up, see how we get on xx, will get her phone seized xx, Then f****** ruin the rest of them'.

PS Boyd also allegedly directed the course of a live investigation into an assault upon the child of Ms A and another when he had a personal involvement in the case.

He also reportedly attended the scene of the incident in the immediate aftermath of the alleged assault on the evening of April 20 2023 and had spoken to those present in a personal capacity.

A fourth allegation says: “PS 1498 Boyd failed to disclose his actions, set out above, to the officer in charge of the investigation, thus preventing onward disclosure to the Crown Prosecution service in compliance with Criminal Procedure and Investigations Act 1996 and potentially compromising the case.”

It is alleged that the sergeant’s behaviour, if proven, amounts to gross misconduct and is so serious as to justify dismissal.

The hearing is due to be held at Cumbria Police’s Penrith headquarters on Tuesday (November 21).
