A MOTORIST who was 'actively misled' before he drove without insurance has been handed an absolute discharge by a court.
Hayden Zi-Jian Sue was charged with driving a BMW 1 Series on Hindpool Road in Barrow on January 13.
The 19-year-old admitted the offence when he appeared at South Cumbria Magistrates' Court without insurance.
But the court found the driver 'had been actively misled into using the vehicle without insurance and satisfied the court on the balance of probabilties that this was an honest and genuine belief in all the circumstances which led to him being misled'.
The defendant, of Holbeck Park Avenue, was sentenced to an absolute discharge, meaning he will face no punishment for the offence.
