A DRUNKEN passenger took out his penis and waved it around on a railway station platform, a court heard.

James Wesley Austin appeared before magistrates after exposing himself on platform two of Oxenholme Railway Station.

The 31-year-old defendant, who is from Lancaster, pleaded guilty to being drunk and disorderly in a public place when he appeared before the bench.

South Cumbria Magistrates Court in Barrow heard the offence took place on January 7.

Lee Dacre, prosecuting, told the court the defendant was first seen calling a woman abusive names at the ticket office and was then seen on the platform drinking alcohol with a friend on the platform.

“A member of station staff decided to check the CCTV and he saw the defendant take his penis out and wave it around," he said.

“He was smoking a cigarette and then showed a female member of the public s picture of his penis on his phone.

“He said it was only a joke.

“He was later shown the footage and confirmed that it was him.”

The court heard the defendant had a previous conviction for drink driving.

Austin, who represented himself in court and explained the circumstances behind the incident.

He told magistrates he was remorseful for what he had done.

He said: “I’m truthfully sorry.

“My head was in the wrong place at the wrong time.

“I had just split up with my girlfriend after finding out she had been cheating on me.”

Magistrates granted Austin, of Whernside Road, a conditional discharge for six months warning him not to reoffend in that time.

They told him: “This was a really silly thing to do.

“However we are not going to fine.

“This is a message to stay sober.

“Do not make another mistake like this.”

The court also told the defendant to pay a victim surcharge of £21 as well as handing him prosecution costs of £85 for bringing the case to court.
