A DRINK driver who was stopped by police has been banned from the road.
Michael Joseph Whytock appeared before magistrates after he was found to have driven while over the limit.
The 28-year-old was said to have been driving his Skoda Fabia through Flookburgh on December 16.
South Cumbria Magistrates Court heard he recorded a reading of 40 microgrammes of alcohol in 100 millilitres of breath, over the legal limit of 35.
The court heard how the defendant, of Cark House Court in Cark, had driven to a pub close to his home for 'a couple of drinks' before visiting a friend at a house party.
Defence Whytock, solicitor Andy Gallagher said: "It's an unfortunate set of circumstances."
Sentencing the defendant, magistrates banned him from the road for the 12 months, the minimum ban for drink driving.
For the offence the bench ordered him to pay a fine of £289, a victim surcharge of £32 and £85 in costs.
