NOTICE OF CONFIRMATION OF PUBLIC PATH DIVERSION ORDERS

On 5th September 2019, the Cheshire East Borough Council confirmed the following named Orders.

TOWN AND COUNTRY PLANNING ACT 1990 (Footpath No 11 (part) Parish of Knutsford) Public Path Diversion Order 2018

The effect of this Order will be to divert the following lengths of Public Footpath No. 11 in the Parish of Knutsford:

That length commencing at O.S. grid reference (OSGR) SJ 7623 7966 and running in a generally north easterly direction for a distance of approx. 582m to OSGR SJ 7662 8009 to a new line commencing at OSGR SJ 7623 7966 and running in a generally north, north westerly direction for a distance of approx. 177m to OSGR SJ 7619 7983 and then running in a generally north easterly direction for a distance of approx. 205m to OSGR SJ 7631 8000 and then running in generally east, north easterly direction for a distance of approx. 145m to OSGR SJ 7645 8006 and then running in generally south easterly direction for a distance of approx. 81m to OSGR SJ 7652 8002 and then running in a generally north easterly direction for a distance of approx. 127m to OSGR SJ 7662 8009. That length commencing at OSGR SJ 7667 8015 and running in a generally north easterly direction for a distance of approx. 152m to OSGR SJ 7679 8024 and then running in a generally northerly direction for a distance of approx. 24m to OSGR SJ 7680 8026to a new line commencing at OSGR SJ 7667 8015 and running in a generally north, north easterly direction for a distance of approx. 113m to OSGR SJ 7671 8025 and then running in a generally easterly direction for a distance of approx. 96m to OSGR SJ 7680 8026.

TOWN AND COUNTRY PLANNING ACT 1990 (Footpath No 4 (part) Parish of Peover Superior) Public Path Diversion Order 2019

The effect of this Order will be to divert that length of Public Footpath No. 4 in the Parish of Peover Superior FP4 commencing at OSGR (OSGR) SJ 7578 7319 and running in a generally west, north westerly direction for a distance of approx. 50m to OSGR SJ 7573 7321, and then running in a generally west, south westerly direction for a distance of approx. 20m to OSGR SJ 7571 7321 to a new line commencing at OSGR SJ 7578 7319 and running in a generally west north westerly direction for a distance of approx. 49m, to a kissing gate at OSGR SJ 7573 7321, and then running in a generally westerly direction for a distance of approx. 17m to OSGR SJ 7571 7321.

Copies of the confirmed Orders and plans have been deposited and may be seen free of charge during normal office hours in the Rights of Way Unit at the office of the undersigned and at the offices of Cheshire East Borough Council, Westfields, Middlewich Road, Sandbach, CW11 1 HZ. Copies of the Order and the Plan may be obtained free of charge from the undersigned.

The Order for Footpath No 11 (part) Parish of Knutsford is not yet operational. It will become operational on the date on which the Council certifies that the terms of Article 2 within this Order, have been complied with.

The Order for Footpath No 4 (part) Parish of Peover Superior became operative on 5 September 2019.

If a person aggrieved by either Order wants to question its validity, or that of any provision contained in it on the grounds that it is not within the powers of the Town and Country Planning Act 1990, or on the grounds that any requirement of that Act or any regulation made under it has not been complied with in relation to the confirmation of the Order, he or she may apply to the High Court for any of these purposes under section 287 of the Act within 6 weeks of 26 September 2019 as required by paragraph 7 of Schedule 14 to the Act.

ROAD TRAFFIC REGULATION ACT 1984 -TEMPORARY PROHIBITION OF PEDESTRIANS (Public Footpath No 3 in the Parish of Chelford)

Notice is hereby given pursuant to the provisions of Section 14 (1) (a) of the Road Traffic Regulation Act 1984, as amended by the Road Traffic (Temporary Restriction) Act 1991, that the Cheshire East Borough Council proposes to make Order the effect of which will be to temporarily prohibit pedestrians on that length of Public Footpath No 3 in the Parish of Chelford commencing on Knutsford Road at O.S. grid reference (OSGR) SJ 8100 7501 and running in a generally north, north easterly direction for approx. 202m to OSGR SJ 8107 7520 and then running in a generally east south easterly direction for a distance of approx. 36m to terminate at its junction with Woodland End at OSGR SJ 8110 7518. This closure is necessary to protect the public from danger whilst works are undertaken in resurface the footpath.

The Order will come into force on 7 October 2019 and will continue in force for a period of six months, or until the works are completed, whichever is the earlier. It is anticipated that the works will take approximately 1-2 months.

Details of alternative route - An alternative route will be provided by the developer whilst the closure is in force.
