A CONISTON man has been spared a driving ban, despite being found guilty of being drunk in charge.

Andrew Dugdale, 60, of Collingwood Close, denied the charge at an earlier hearing, but was found guilty by magistrates.

He was accused of being drunk in charge of a vehicle at High Cross Car Park, Coniston, on November 23 last year.

When tested, Dugdale was more than three times the legal limit, with 128 microgrammes of alcohol in 100ml of breath.

The legal limit is 35 microgrammes.

Appearing Kendal Town Hall, Dugdale was handed 10 penalty points and ordered to carry out 40 hours of unpaid work in the next 12 months.

Dugdale was spared a driving ban after telling the court he is addressing alcohol issues and showed programmes he has since undertaken.

Magistrates were satisfied the risk of re-offending has been significantly reduced.

He must also pay a victim surcharge of £85 and court costs of £310.
