A MAN who was found growing cannabis has had his curfew lifted so he can go to Tenerife for a week.

Andrew Monaghan, 49, from Mount Pleasant in Barrow, originally appeared in Furness Magistrates’ Court on June 16 charged with producing the Class B drug and abstracting £333.08 of electricity. He was given a 26-week curfew by the magistrates.

He appeared before the court again on Tuesday to ask for his curfew to be lifted for one week.

Mr Trystan Roberts, defending, said: “Before the curfew was imposed and before he came to court at all a family holiday to Tenerife had been organised.

“The arrangements were made in March. His parents live in Spain and they will be celebrating their 50th wedding anniversary. It’s a celebration he and his family are looking forward to, it’s been arranged for a long time.”

The court heard that Monaghan is not in a position to see his parents often and that they only come back to England once a year.

Mr Roberts also explained that Monaghan had performed well on his curfew and explained how it has been a punishment for him.

He said: “This is an unusual application, it’s supposed to restrict liberty, however on this occasion the arrangements were made before the order was imposed.”

The curfew, which means Monaghan has to remain at home from 7pm until 7am, is due to expire on December 15.

Presiding magistrate Mr George Butler said: “We are going to revoke the current community order and make a new one for 60 days under the same conditions and that will exclude the week of November 2 until November 9.”

Monaghan will be under curfew until December 26.
