Barrow man used mastiff dog ‘as weapon’ on police

A MAN who set his dog on a police officer has been sent to jail.
Philip Nigel Kitching, 46, of Longway, Barrow, encouraged his mastiff dog to attack PC Andrew MacFarlane during an assault on July 9.
Furness Magistrates’ Court heard that Kitching repeatedly shouted at his out-of-control animal to “bite” and “attack” the officer in the communal hallway of Tay Court, Barrow.
Officers had been called to the property after reports of a disturbance involving Kitching and his partner, Annette Wright.
PC MacFarlane struck and kicked the dog during the attack as it tried to bite his chest and legs.
A statement by the officer read aloud at Furness Magistrates’ Court on Tuesday said: “Kitching was trying to hit me with a closed fist several times in the hallway.
“I tried to pull him to the floor. It was obvious that he was drunk.
“The only reason why I didn’t suffer injury from the animal is down to luck.”
Officers used a Taser gun to restrain Kitching, while the dog was brought under control by Kitching’s partner.
Mr Lee Dacre, prosecuting, said it was fortunate that the officer did not suffer serious injury in the incident.
He said: “This was a sustained attack, a long attack.
“It was a potential fatality if the dog had got to the officer’s throat.”
Chairwoman of magistrates, Kathryn Alexandra, sentenced Kitching to 26 weeks in prison for assaulting a police officer in the execution of his duty and 12 weeks for causing damage to the police officer’s body armour.
The sentences will run concurrently, meaning Kitching will serve 26 weeks in jail.
She said: “This was a truly terrible assault on a police officer. You used your dog as a weapon against him.
“You maintained your innocence right to the end of the trial.”
Kitching was convicted of owning an out-of-control dog in a public place and failing to comply with a control order made in June 2012.
