Barrow man knew girl was underage claim witnesses

THE trial of a man accused of having sex with a girl he knew was 15 years old, has heard how the girl’s mother found out about their relationship by reading her daughter’s Facebook messages.

Kyle Hubbold, 25, of Rawlinson Street, Barrow, is charged with two counts of sexual activity with a child.

The mother of the alleged victim told Barrow Crown Court yesterday that she discovered messages between her daughter and Hubbold in February 2012, saying that her daughter had used the morning-after pill following a night the pair had spent together in June 2011.

The mother confronted the girl about her relationship with Hubbold and, during their “heated discussion”, slapped her daughter for which she received a police caution.

The girl claims Hubbold had sex with her on two separate days in the summer of 2011 at his then-home in Egerton Court, Barrow.

She says he knew she was 15 at the time as they exchanged names and ages when they first met.

However, Hubbold claims he had sex with the girl on one occasion and that she told him she was 17.

Mr Mark Lamberty, prosecuting, said the girl reported the incidents in January 2013 and that it was common knowledge that the girl was still at school.

Two female witnesses who know the alleged victim also told the court that Hubbold admitted to them separately that he had slept with the girl on two occasions.

He allegedly told them that he did not know the girl was underage on the first occasion, but did on the second occasion.

The first witness said: “(Hubbold) said he slept with her on two occasions.

“The first time (the girl) had told him she was 17. He said the second time he knew that she was 15.

“He said ‘I have already slept with her once before, what difference does it make if I do it again?’”

However, the second witness claims Hubbold said he had sex with the girl twice on one day and was confused by what he had meant about knowing her age the second time.

Hubbold denies the charges. The trial continues.
